These Terms of Service (hereinafter referred to as the “Terms”) apply to all access and use of the website, store features, tools, content, products and services operated and provided by Precise Survey Tool (referred to as “we”, “us”, or “our”). Our platform is powered by Shopify, which supports the provision of all our shopping and functional services (collectively, the “Services”) for customer use.

All stated delivery times are estimated values and are not guaranteed. We assume no liability for shipping delays caused by carrier processing, customs clearance procedures, weather conditions, or any events beyond our reasonable control. Once products are transferred to the designated shipping carrier, all ownership rights and risk of loss or damage transfer to you.

Section 6 – Intellectual Property Rights

All content available via our Services, including trademarks, brand logos, text, graphics, images, videos, audio, product reviews, design layouts, and content selection arrangements, are the exclusive property of Precise Survey Tool, its affiliates, or licensed partners. Our store and Services are hosted and powered by Shopify, which enables platform operation and transaction functionality. All purchases and contractual transactions are conducted solely between you and Precise Survey Tool. Shopify is not involved in and assumes no responsibility for any sales, product quality, order fulfillment, or transaction-related disputes between you and our store.
You fully release Shopify and its affiliates from all liabilities, claims, damages, or losses arising from your use of our Services and your purchases on our platform.

No Agent may access our Services unless fully compliant with the identification and operational requirements below. We may refuse Agent access at our sole discretion.
We reserve the right to implement technical restrictions to limit or regulate Agent access and interaction with our platform.
All Agents must: clearly identify their status and name via user agent string labeling (“Agent/[agent name]”) in all access requests; refrain from mimicking human behavior or bypassing CAPTCHA and anti-bot verification measures; respond truthfully to human/automated verification prompts; and avoid circumventing any platform access control measures.

Section 15 – Termination

We may terminate your access to all or part of our Services at any time, without prior notice, at our sole discretion. You remain fully liable for all outstanding fees and obligations incurred prior to termination.
All clauses related to Intellectual Property, Feedback, Termination, Warranty Disclaimers, Liability Limitations, Indemnification, Severability, Governing Law, and Privacy Policy shall remain valid and enforceable after service termination.

We will notify you of all indemnifiable claims promptly. We may assume exclusive control of claim defense and settlement at your cost, and will not approve non-monetary settlements without your reasonable consent. No ambiguity in these Terms shall be construed against the drafting party.

These Terms and all related service agreements shall be governed and interpreted in accordance with the federal and state laws applicable to the headquarters jurisdiction of Precise Survey Tool. You consent to the exclusive personal and venue jurisdiction of the courts within this jurisdiction for all related disputes.
